In New York State, Section 390.40 of the Criminal Procedure Law grants an individual the right to submit to the Court a Pre Sentence Memorandum. Court Consultation Services has the expertise to prepare this vital document for our clients. Our reports are highly individualized, taking into account our client’s unique life history. We listen carefully to our clients and learn their strengths and weaknesses, so that his or her behavior can be understood in the context of their life. We refer clients for appropriate treatment when necessary and monitor the treatment. We assess the needs of the client from many sources including the client interview, the interview of family members and pertinent others. We collect client records from their schools, employers, physicians, mental health workers and anyone we feel will help us to better know and address our client’s needs.
Our approach is holistic in that we address the factors and circumstances that contributed to our client’s behavior. Our clients take corrective actions to change their behavior, while we address the concern of community safety. We work with drug and alcohol treatment in patient and out patient facilities, religious groups, individuals, businesses and organizations that have the resources to address our client’s problems and provide alternatives to incarceration. We are familiar with programs within the State Department of Correctional Services that can address our state incarcerated client’s needs.
For our clients charged in federal district court, we will assist in developing a fair plea agreement, and will review the charging instrument, related material and sentencing guidelines. We will also conduct a thorough interview with the client to obtain social history, mental health and substance abuse information as well as the circumstances that may have contributed to the client's involvement in the instant offense. All relevant material is analyzed to determine the appropriate sentencing guidelines, departure issues and other factors that might mitigate sentencing. These factors may reduce or eliminate a term of imprisonment. Sentencing recommendations are developed to include special conditions that can assist the client to successfully complete a probation term.
